LaPORTE CO. — His wife is in jail accused of killing their newborn baby. But Garry Phillips maintains not only is his wife, Kathy, innocent of murder, she wasn't even pregnant.

It's a mystery that began much earlier this year. In March, Phillips called police after he found the body of a newborn baby in woods a few hundred feet from his Rolling Prairie home.

Last month, six months after the discovery of baby Jane Doe, prosecutors charged Phillip's wife Kathy with murder. Investigators claim the baby was the couple's daughter.

Police say DNA results show the two were 3.6 trillion times more likely than any other random couple to be the baby's parents.

Garry Phillips spoke with WSBT and says he doesn't know why the results came out like they did. He insists they are innocent. He says his wife is suffering in jail, he is in financial ruins and their 3-year-old daughter, Ella, is suffering the most.

"It's just really hard with her and I know it bothers her because... she just wants her mom," he said.

Kathy Phillips is in jail charged with the murder of the baby. Ella was with her mother when police came.

"She saw them put handcuffs on her," Garry said.

Kathy and Ella were getting in the car when police showed up.

"They come runnin' out of the woods with their guns pointed," said Garry. "There's no need for that."

Police believe Kathy gave birth to the full term baby girl he found dead. But Garry disagrees.

"I know that ain't my kid. And I know it isn't my wife's kid. That much I do know."

Garry says Kathy she gained 70 pounds when she was pregnant with Ella, but was been slim before and has been since.

"My wife weighs 116 pounds. When she was pregnant with my daughter she weighed 208 pounds. For a woman... you would know if someone was pregnant."

Investigator's say they aren't sure whether the baby was born alive or dead.

Kathy's trial begins March 12th--exactly one year to the day since the baby's body was found.

Be interesting to have seen the reaction of Kathy once her husband "found" the baby. It is all very strange. My sister in law hid her pregnancy in High School, she was a cheerleader at 8 months pregnant and you would have never known. Baby found in March, with the IN winters and all the layering you can do quite a bit of hiding. I just pray someday we will know the rest of the story. Did the husband known what was going on? Did Kathy kill her baby? I did not follow the story....

There is nothing in this world that is 100% all the time, every time... DNA can be wrong just like everything else in the world. If you research DNA you will find that it usually only claims 99% probability or some say %99.99 certainty. That sounds like a sure thing, but that still means it's not 100% failproof folks. I don't know this woman and for all I know she's guilty... I'm just making a point.
