Second indictment handed down in Polizzotto shooting

(WSBT) Another person is facing federal charges for illegally selling a gun to the man who shot and killed a South Bend police officer.

Scott Barnaby had two guns in his room on the night he shot South Bend officers Ptl. Michael Norby and Cpl. Nick Polizzotto. Polizzotto died in the shooting.

On Friday morning, Jason Katz surrendered to federal authorities inside the courthouse after a grand jury indicted him on three federal gun charges.

WSBT was the only station there this morning when Katz turned himself in. His wife was by his side.

Neither had any comment. The indictment charges Katz caused the illegal sale of the gun by not performing a national background check.

Police say Barnaby had two guns on him at the time of shooting.

Sources say this is not connected to the indictment against Ronald Wedge.

Wedge was indicted earlier this week and will appear in court today on three charges of falsifying dates and information on the gun sale application.

Investigators say wedge sold a gun to Barnaby before a background check cleared him.
