Katz pleads not guilty to charge of illegally selling gun to Barnaby

(WSBT) Jason Katz has pleaded not guilty to three federal gun charges. He is accused of illegally selling a gun to Scott Barnaby last month. Barnaby eventually shot Patrolman Michael Norby and shot and killed Cpl. Nick Polizzotto.

Katz turned himself in at federal courthouse in South Bend just hours before his first court appearance.

During the hearing Schmid said Barnaby used the gun to shoot at signs in the area near the Wooden Indian Motel early in the morning on April 24.

Witnesses called police, who responded to Barnaby’s room at the motel. Police believe Barnaby used a different gun to shoot the officers.

Katz is charged with basically selling the gun to Barnaby off the books.

The charges allege Katz didn't perform a national background check on Barnaby, didn't take down his name or any other type of personal information and made a false report into his sales record.

After the court appearance, Katz literally ran from the media, not giving any comment. His wife and his attorney, Andre Gammage, also refused comment.
