Trial Delayed In Case of Dead Newborn

(WSBT) The trial for a woman charged in the death of a newborn has been delayed.

Kathy Phillips was arrested last fall after police discovered Phillips DNA matched that of a baby found in a LaPorte field. Friday, the judge granted a defense request to delay the trial.

Phillip’s attorney would not comment on why he’s asking for additional time, but he’s also asking for a change of venue due to the amount of publicity this case has gotten

The publicity began when a dead baby was found in a garbage bag in a field next to the Phillip’s house last march. Phillip's and her husband say she was never pregnant and was too thin to hide it.

But police say DNA evidence proves the Phillips are 3.6 trillion times more likely to be the parents than any other random couple.

Phillips was arrested last fall and bonded out a month later. The prosecutor says a change of venue won't affect his case.

“The facts of the case are the facts of the case,” LaPorte County Prosecutor Robert Beckman told WSBT News. “I’ll present it to whomever, so it will have no impact on this case.”

The judge will meet with Phillips and attorneys this summer to decide whether to grant the change of venue. The judge says that determination will be made upon the amount of publicity the case gets up to that point.
