Homeowners file lawsuit against Geocel

ELKHART — Neighbors filed a lawsuit against a local company for not telling them about a water contamination problem for years.

Geocel Corporation in Elkhart makes adhesive sealants. It's making city water available to 100 homes in the Meadow Farms subdivision after investigators found toxic chemicals had leaked into the groundwater last year.

The company told neighbors about the contamination in June. A company spokesperson says that's when they first discovered it, but neighbors believe the company knew about it for years.

"Geocel was very proactive and informed residents as soon as the contamination migrated to the neighborhood. The residents were also given clean water," said Michelle Sinning, a Geocel spokesperson.

Attorney John Ulmer filed a lawsuit on behalf of 14 families. The suit claims the contaminants may have caused miscarriages and cancer.

"We have seen records from IDEM and Elkhart County where there have been these toxic chemicals that have been released into the ground water," said Ulmer.

In a written statement, Sinning said Geocel "disagrees with many of the allegations contained in the complaint and intends to undertake a vigorous defense of the litigation."

"They should not have to live with this at all. This is why we have these rules and regulations and IDEM is to try to prevent these. I don't know what the situation was and how these chemicals got out," Ulmer said.

Ulmer says he's ready to fight because the toxins could be causing serious health problems.

"Their biggest fears may have been it's caused miscarriages. Some people have had cancer. Was it caused by that?" Ulmer asked.

Sinning declined to address questions about the health issues.

Ulmer and his experts are trying to determine exactly how long Geocel knew about the contamination and whether any other health problems are related to exposure to the toxins.

He says lawsuits, like this one, could take years before they are settled or taken to court.

No one is looking for free money , people have been sick and are sick and are probly dieing . The testing done has only been to state standards , I think when its all done Geocel knew of the leak and thought they had done everthing that they could do back then to kept it in check. But it did'nt work .Geocel has never went to poeple and ask about there health . So don't go bad talking Good People that have been Polluted .

I know people who work for this company, I can assure you that the owner did not know about the spill. He has done everything in his power to make sure that all have been taken care of, he came forward. He could have kept his mouth shut and said nothing, who would have known? This was not something that was hidden on purpose. It was an ACCIDENT, that he is trying to fix. I think its SAD that 14 families can only see FREE MONEY! That is the sad state of our country today! Regardless of when this company found out about this problem is not the issue. The issue is the health of the people that live in that area. The company should be held accountable. They contaminated the ground water. They should have had measures in place so that would not happen.

I worked for this company for many years and know these people and OWNER very well and do not believe for a minute they hide this from anyone. I also was not surprised when they came forward and would defend them without question. Just so the general pubic knows an ex-employee (in the lab) during this time lived and still lives in the area that is contaminated do you think if he had knowledge of this he would leave his family there? When I worked there the OWNER built a house on the river south
