MISHAWAKA — A Penn High School student accused of planning a Columbine-style attack appeared in court for a detention hearing Friday morning, and authorities in Ohio arrested a suspect in connection with the threat.

Police arrested the 16-year-old at the school Tuesday after a resource officer found disturbing postings on the popular website MySpace.

He’s being held at the Juvenile Justice Center. Because of the severity of the allegations, the judge decided to keep the 16-year-old in custody.

The suspect’s mother and uncle appeared beside him during the hearing Friday morning. Both appeared to be very upset by the judge’s decision. Before the suspect was arrested, he was staying with his uncle.

The judge also ordered a psychiatric evaluation be conducted. The process will be split into multiple parts. First, psychologists will interview the suspect and his family. Then they'll review his police and school records.

"To understand what his emotional functioning is, what is his personality structure, and then the end piece will be looking at risk level — how risky he is to himself and to other people," explained Juvenile Justice Center Executive Director Bill Bruinsma.

The evaluation doesn't just help doctors treat the suspect. It will also gives prosecutors a better understanding of the kind of person they're dealing with.

“This is just another piece that we really need so we can make an informed decision that is in the best interest of justice for everybody as to what the appropriate path to follow is from here,” explained Deputy Prosecutor Eric Tamashasky.

The suspect is accused of discussing plans with another person to carry out a Columbine-style attack at Penn High School. He is being held on preliminary charges of conspiracy to commit murder. Prosecutors have until next Thursday to file formal charges.

Authorities near Cleveland arrested 33-year-old Lee Billi, who they say e-mailed the teen about conducting the attack. Their conversations included researching how to make bombs and obtaining a handgun.

Lakewood Police Chief Tim Malley says Billi was charged Thursday with conspiracy to commit aggravated murder.

Malley says he doesn't know how far along the two were in their alleged plans.

A computer was removed from Billi's home in Lakewood in a search Thursday.

Billi is being held in jail and is expected to be arraigned by Saturday.

Whatever Annette! That kids problems, whatever they may be, could have killed MY kid-so I am not very sypathetic right now towards him or his family-sorry. BTW-I am a Christian.

to Sue..guess what..the parents of the columbine kids could have made the same statement as you. Until you have walked in that parents shoes you should reserve judgement. It could happen in ANY school and ANY family. Depression and mental illness is very easy for a kid to hide. Parents get blind sided everyday..instead of condemning them..I pray for them..that God eases their burden during what has to be horrible. That which you are most judgemental about you will someday face..it's called karma

To Penn Mom - I would say you are the minority. Most Penn parents are very quick to bash other schools. Same with Mishawaka. I recall many instances when SB students were painted in a negative light. There are many good students at SB schools. It is not their fault there are students who are products of bad parenting and poor admin. Point is, no school is perfect and maybe this will reinforce that to the parents who feel Penn is. Maybe they should spend more time parenting instead of boasting.

To South Bend: Seems to me you have this backwards. It's the South Bend people like you who seem to keep bashing Penn. No one at Penn ever said they were better. It's just those outside looking in who seem to have the attitudes about it. Penn is just a high school like any other with teens who need supervision and guidance from their parents. It's the ones who don't have that that get out of control...any school, anywhere!

To the PHS student:You may be surprised how many people "don't seem the type" to commit violent acts. Believe me when I say, there is more to this than they are telling us. The prosecutor is not going to release all of the information before the trial. The police know the difference between a teen spouting off and someone who poses a real threat. They aren't going to take it to this limit if he had just made a few comments out of anger. It had to be pretty credible for them to arrest him. Scary!

PM None, it's not a question of how stupid is HE! It's a question of how long until someone says to themselves, "I'll bet I can do it!" and then where are you? Everyday this shows up in the news it gets a little more play, a little more speculation, a little more interesting to someone with what they think is an ax to grind that decides it's their turn at bat. It happened, it was reported, now let it go. Nothing good can come from trying to paint a new face on this story every day. Let it go!

Where are all the Penn folks who are so quick to bash South Bend students (I said students, not schools)? Oh wait, they fell off of their pedastal. No school is perfect. Maybe now you will get a clue.

"Why wasn't he living with his mother? Where is his father? Let me guess, his uncle is like 21 or something." What business is it of yours? You obviously don't know the situation, and asking here isn't likely to get your questions answered. I will tell you his uncle is not 21 and there is a lot to the story that hasn't and shouldn't be released.

In response to the Penn student who knows him, how can anyone be sure he would not go through with this? That is a ridiculous statement. And I don't believe this type of thing happens all the time in high schools. I am the mother of two H.S. students and they or no one they know does or says stuff like this!

This is sickening!! He should be charged as an adult and locked up for life!! And for his mother and uncle to be upset over the judges decision is even more disturbing!! If this were my own child, I would want a lot more that a psych eval!! What is wrong with kids in this world today!!!??????

Where are the parents? How could a child have this stash in their home and they not be aware of it? How was he able to buy the guns and stuff - it seems to be so easy to buy things. Where did he get the money? When parents become liable for the actions of their kids, then things may begin to change. As a parent I cleaned my kids rooms now and then and they knew I did it and by golly they didn't keep anything around they wouldn't want me to see.

I have heard from a reliable source that one would never expect this from this kid. I guess you can't trust anyone! Why wasn't he living with his mother? Where is his father? Let me guess, his uncle is like 21 or something. I think they need to really keep him locked up for a very long time. He is obviously a serious threat to society! School sure isn't what is used to be.

WELL I AM A PARENT OF A STUDENT AT PENN AND I AM NOT! I HOPE THIS STUDENT IS LOCKED UP! TO ME THIS IS TERRORISM! NOT ONLY ON OUR CHILDREN BUT TO US PARENTS! AND FOR HIS UNCLE AND MOM TO BE UPSET ABOUT THE JUDGES DECISION TO KEEP HIM IS UNBELIEVABLE! I CERTAINLY DON'T WANT HIM ON THE STREETS! THANK YOU TO THE OFFICER THAT DID THE DIGGING!

It didn't say the student that wrote the thing on the bathroom wall was the same student that was arrested. Looks like just a coincidince. Still kinda scary though.

I hope that they just don't "lock him up and throw away the key" There seems to be other issues going on here that need attention. A child just doesn't start plotting out these types of retaliation for no reason. Has he been bullied and nobody has cared to address his complaints. Or is the mentality still in practice that the "popular" or "jocks" are overlooked when "teasing-bullying-etc., behavior occurs"? He needs help. . maybe the postings were a way to get attention - even negative.

1st thing that came to my mind was this person being the one who placed the threat in the bathroom no too long ago that had been deemed "harmless"..NOTHING should be taken as a hramless prank when such things occur........

I am a student at Penn, and I know the kid that they took to JJC. Granted I find him a little disturbed, but anybody who really knows him would probably tell you he wouldn't actually go through with something like this. But I think if the school is going to be "scanning" everybody's they are going to find a lot of stuff they don't like. And labeling every situation like this "Columbine-style" is just embellishing the reality of a something that happens in most high schools
