SOUTH BEND — A 27-year-old man was charged Monday with aggravated battery and reckless homicide in the death of a 63-year-old man who had been on his first night of duty as a security guard at a South Bend bar early Saturday.

Prosecutors allege that Joshua M. Kati of South Bend struck James E. Muddiman Sr. on the right side of his face after Muddiman stopped Kati’s girlfriend from leaving with an alcoholic beverage. The incident took place at closing time, 3 a.m., inside South Bank bar in the 1700 block of Lincoln Way East.

According to witnesses, Muddiman fell to the ground and struck his head on the concrete floor. He was taken to a local hospital, where he died of severe head injuries and brain trauma later that day.

Kati was serving a 20-year sentence on home detention for dealing cocaine. He had been convicted of selling nearly 30 grams of the drug to an undercover officer in 2004.

Prosecutors on Monday asked for a higher than standard bond of $100,000 cash because of Kati’s criminal history. Prosecutors say Kati has been convicted of domestic battery, theft, phone harassment, resisting law enforcement and two counts of consuming alcohol as a minor.

Muddiman worked as a part-time security officer for Indiana University South Bend and ran his own private investigation and security service company, called Infinity Investigations, out of his home in South Bend's near northeast side neighborhood.

Efforts to contact Muddiman's family members Monday were unsuccessful.

Why in the world would a judge think that this or any convicted criminal could be trusted to stay within the rules of Home Detention? Yes sir, your honor sir, the fox should indeed be just fine in the hen house!

I read where they want to raise his bail amount because of his crimial record. It seems to me he should be awaiting trial in prison. If he was on house arrest that means he was on probation. I would think that being in a bar, drinking, and killing someone would be a violation of his probation. Wouldn't that mean a person would have to finish out his sentance in prison? I would think so. Say hi to Mosses Geiger, Harrel Kriner and Randy Reeder (Manhole murderer), other garbage that polluted S.B.

This is exactly the reason why alcohol should be illegal and people that drink alcohol should be criminalized to the fullest extent. When will the Judges of St. Joseph County start throwing these repeat offenders in jail, and then throw away the key. Josh was convicted of selling more than 30 grams of cocaine from his house, and where did the judge sentence him to? His house for 20 years. Obviously if he was at the bar the "house arrest" didn't matter anyway. The Judge should be arrested for being an accomplice for not doing his job!
