Driver who hit bicyclist turns self in

SOUTH BEND — The man involved in a Wednesday hit-and-run accident that critically injured a bicyclist turned himself in to county police Thursday afternoon.

In the presence of his attorney, the man, whose age and place of residence are unknown, admitted to being the driver of a vehicle that struck 40-year-old Patrick Sawyer about 5 a.m. Wednesday in the 17000 block of Cleveland Road, county police spokesman Sgt. William Redman said. It is generally The Tribune’s policy not to name suspects until they have been formally charged by the prosecutor.

Sawyer, of South Bend, a well-known local canoeist, was on his way to the Michiana YMCA and was wearing a helmet and reflective vest when he was hit. A nearby resident heard the accident and ran outside to find him lying on the ground next to his mangled bike.

Although Sawyer’s injuries were initially reported as non-life-threatening, his condition has since worsened, Redman said, and is now critical. In an attempt to relieve pressure on his brain, he said, he is currently in a medically induced coma.

Redman said the suspect likely will not be taken into custody after questioning. Police are in discussion with the prosecutor’s office about possible criminal charges, he said.

I would re-think the comment that your local law enforcement is a "joke." While not every case will have the outcome that you or even the police, prosecutors, judge etc would like, these people undergo great personal risk to serve the public and you would expect their help if you were in a dangerous situation. My thoughts and prayers go out to the injured bicyclist and his family.

I certainly hope Mr. Sawyer’s family considers hiring an attorney and files suit against this unidentified driver…who left the scene of an accident and has possibly injured this poor gentleman. What happens to this poor family if he is no longer able to work and provide for them? Does anyone else think that “Keller and Keller” might be the only ones who will fight for them?

Once again all of you CSI fans need to let the police and prosecutor handle the investigation. None of us were there to know what happened. I have no doubt that he will face criminal charges. Even if he was arrested immediately, he would have a bond by today and be out awaiting trial.

This is to add to my other comment. I know that Mr. sawyer is a good biker he was wearing a reflective vest, lots of blinkers and a helmet. With out his helmet he would have died so that shows you he is a good biker. He comes from a family of 11 and married in to a family of 8 so he has a lot of loved ones and we don't think what he did was wrong. I love you Uncle Pat and you will always be in our prayers.

Good for the driver to finally own up, but let's hope he doesn't escape justice. Fact is, cyclists have a legal right to use the roads, and drivers have a legal obligation to avoid them, as well as a legal obligation to remain at the scene of an accident. If drivers drove slower and sober, they would be easily able to avoid cyclists. As gas prices keep increasing, there are going to be more bikes and fewer cars. Drivers had better learn to watch out.

I ride a bike on the street on a regular basis and always need to assume that drivers don't see me. As a driver, I definitely wouldn't expect to see a cyclist on Cleveland Road at 5AM. This is bad for all involved: Mr. Sawyer apparently took all the proper precautions for visibility and safety, and we can assume that the driver did not want to hit Mr. Sawyer. We just need to say prayers for both families, and suspend any judgment of our own.

Mr. Sawyer is my uncle and knowing him, it was not his fault. He knows all the rules of the road. He is vary smart and caring. I want everyone to keep him and his four kids and wife in their prayers. He is so nice that he's like my father. I am always around him and he treats me like his own kid. He is a great paddler he tries to get everyone else in to it even if he does not know them. I miss you Uncle Pat get better soon, you are always in our prayers.

The young man who was involved in a hit and run in Elkhart was arrested after turning himself in and then his name was plastered all over the meadia. What is the difference here? Maybe he would have been innocent if he did not run! Hit and run is considered a serious crime. In cases of injury, the law in hit and run incidences requires the "hitter" to stop and assess victims' needs, whether that includes calling emergency response officials or waiting until help arrives. Under hit and run law, if a hit and run car accident results in death, it is automatically charged as a felony crime regardless of who was at fault in the accident.

I agree. Get bikers off the road. No contest against a 3-5 thousand pound vehicle. The difference in speeds creates dangerous situations that drivers can't always avoid.
