Snyder gets six months home detention in Roseland council assault

SOUTH BEND — Former Roseland Town Council member David Snyder was sentenced Wednesday to six months of home detention with electronic monitoring for battery of fellow council member Ted Penn in January 2007 at the Town Hall.

St. Joseph Superior Court Judge Jerome Frese imposed 300 hours of community service and a year of probation.

Snyder will also have to pay restitution that could total $5,000. The final amount has not yet been determined.

The sentencing hearing Wednesday afternoon lasted nearly two hours.

Snyder, 56, was convicted July 31 of the misdemeanor charge after a four-day jury trial. Snyder was acquitted of the more serious felony charge of intimidation.

Penn testified during the trial that his entire body was severely bruised when he was struck and kicked by David Snyder and also kicked a few times by David’s father, Russell Snyder.

David Snyder apologized Wednesday to Penn and all the people in Roseland.

Snyder could have received up to a year in jail and up to a $5,000 fine for the misdemeanor battery charge.

If he had been convicted of the felony, he could have faced up to three years in prison and a fine up to $10,000.
