Snyder won’t appeal battery conviction

SOUTH BEND — Former Roseland Town Council member David Snyder said Tuesday he has decided not to appeal his misdemeanor battery conviction.

As requested by St. Joseph Superior Court Judge Jerome Frese, Snyder and his lawyer, Edward Hearn of Merrillville, Ind., filed a notice of their intent not to appeal.

In July, a jury convicted Snyder of the charge which stemmed from an altercation he had with fellow Town Council member Ted Penn in January 2007. Penn suffered injuries to his head and body.

Snyder was acquitted of a felony intimidation charge.

Snyder was sentenced last month to six months of electronically monitored home detention, a year’s probation and ordered to pay restitution for Penn’s expenses.
