MISHAWAKA — A review board ruled that a Mishawaka police officer acted in accordance with departmental policy when he shot and killed a man in Osceola in August.

The Mishawaka Police Department Shooting Board cleared Detective Jeremy Tyler of wrongdoing in the August 24th shooting death of 43-year-old Eugene Nusbaum.

Tyler was off duty when he said he found Nusbaum trying to steal a catalytic converter out of a minivan at Schneider Used Car Lot on Lincoln Way West.

Tyler shot Nusbaum after a struggle at the door of Nusbaum’s pickup truck.

The prosecutor's office previously cleared Tyler of any wrongdoing because they said he acted in self-defense.

The Mishawaka Police Department Shooting Board consists of six Mishawaka police officers: the chief of police, three assistant chiefs of police, Tyler’s captain and a Mishawaka Police firing range instructor.

Tyler remains on administrative leave.
