After hung jury, second trial begins for South Bend mother

SOUTH BEND - A year after a trial that ended in a hung jury, a 36-year-old woman will be tried again on charges that she injured her 3-month-old baby in 2005.

Jury selection got under way Monday.

Barbara Schrock faces one count of neglect of a dependent, and one count of battery, both Class B felonies. Her mother, Elaine Schrock, faces one count of neglect of a dependent, a B felony.

Court documents say Barbara Schrock called an ambulance July 27, 2005, and accompanied her 3-month-old daughter to an emergency room, where doctors found the infant had suffered life-threatening injuries and “severe health problems.” The injuries included a fractured skull and broken leg bones, ribs and forearms.

The charges against the grandmother (Elaine) are based on the fact that she (as a high school nurse) didn't immediately take the baby to ER when her temp was LOW. Barb and Elaine both called a pediatrician and reported the low temp, and the doctor made no big deal of it. Attributed it to inaccuracy rather than an actual symptom.

The father of the baby took a voluntary lie detector test, and past. I can guarantee he had no idea what that heartless monster was doing to that poor baby. Many jumped to the conclusion that SHE is guilty. How do you KNOW that SHE is the one who caused the injuries? I can tell you that by the evidence provided in the first trial, no one saw or heard HER abuse the baby. No one saw the baby act as if it was in pain.

There was no evidence pointing towards BARB as THE culprit. From testimony given, there was no way to tell who of the six that had access to the baby actually did it. One can easily post on a blog that they KNOW someone is guilty, but when all the evidence is given, and one must rely on the evidence, the picture is not clear at all.

I can say I personally did know Barb- and what I knew of her would lead me to believe she is definitely capable of this. She has not one, but two children, only one of which is lucky enough not to have suffered this fate. This woman is crazy- I speak from personal experience. What ever happened to innocent until PROVEN guilty? Who decided the MOTHER gets the charges in this case? Why not the father? Have none of you read the accounts of parents wrongfully accused of hurting their infants and then specialists find that it was not abuse at all but other little-known neurological factors. Let's not be judging until the facts are out especially let's not judge based on media reports. Do YOU ever want to be on the wrong side of the media?

The public tries a person long before a court does. We must be careful not to assume someone is guilty especially in a case as sensitive as this one. Innocent until proven guilty is still the law of the land. Barbara Schrock has been treated shamefully by the courts.

It's really unfortunate that someone can physically harm their child in such a way and still be out after 3 years a free woman. I can tell you Barb has no conscience and is a habitual liar. I have no doubt she is guilty, but has probably convinced herself otherwise. Someone who lies as much as she does begins to believe their own lies after a while. It's just too bad jury couldn't see through it- hope this one does and brings justice for her daughter who will never have a normal life now.
