Complaint: Snyder not meeting sentencing terms

SOUTH BEND — A court hearing has been set for former Roseland Town Council member David Snyder to address complaints that he has failed to fulfill community service requirements stemming from his conviction in July for misdemeanor battery.

St. Joseph Superior Court Judge Jerome Frese set the hearing after he received information from DuComb Center that Snyder has failed to contact the Charles Martin Youth Center to schedule community service hours. According to DuComb, the judge wrote, Snyder has completed only 10 or 11 hours of community service.

Snyder sent DuComb, a work-release center, several requests for travel permission and copies of medical information to support his position that he is restricted in the community service he can perform, according to court documents.

Snyder was ordered to serve 300 hours of community service after a jury found him guilty of misdemeanor battery for hitting and kicking Roseland Town Council member Ted Penn.

Snyder said Friday he was not aware that a court hearing had been scheduled for Thursday, and deferred questions about the case to his attorney, Edward Hearn.

Hearn could not be reached for comment Friday afternoon.

On his conviction for battery, Snyder was sentenced in September to one year incarceration, but six months were suspended and he was to serve six months in home detention with DuComb Community Service. He was also placed on probation for a year.

Typically, when a defendant violates the terms of his probation, the prosecutor may file a request to revoke his probation, which means the defendant could be ordered to serve suspended prison or jail time.

Catherine Wilson, a spokeswoman for the prosecutor’s office, said Friday that a petition to revoke placement has not been filed in Snyder’s case. She said that a prosecutor will be present at Thursday’s hearing, at which there will be discussion of whether Snyder has complied with the terms of his sentencing.

The hearing has been scheduled for 9 a.m. Thursday before Frese.
