Open burning at VIM Recycling Inc. in western Elkhart County is the alleged Clean Air Act violation that lead the U.S. Environmental Protection Agency to cite the company on Friday.

A news release from EPA’s Region 5 office in Chicago, indicates VIM officials now have seven days to meet with the EPA about the violations.

According to the EPA, VIM violated Indiana’s EPA-approved regulations that prohibit open burning at the company’s operation at 29861 Old U.S. 33.

The citation is the latest action involving the company.

Earlier this week, a VIM worker died at the company’s recycling operation after being struck by a front-end loader. In 2007, a worker there died and another was seriously injured after an explosion at the facility.

A nearby neighborhood group has filed suit against VIM, alleging the company caused injuries to area residents because of smoke, dust and “extreme” noxious odors from processing waste materials.
