The Fort Wayne-South Bend Catholic Diocese has been ordered by a federal magistrate to hand over documents to a former teacher who claims she was fired for undergoing in-vitro fertilization.
Emily Herx filed a discrimination lawsuit against the diocese two years ago.
She claims she was fired because of the procedure which violates Catholic doctrine.
Attorneys for the diocese say teachers are required under their contracts to abide by Catholic teachings.
The documents ordered released include names of teachers in all 41 schools in the diocese that signed the same "morals clause" as Herx.
