The convicted murderer of Greg Piechocki is now going to the Indiana Supreme Court.

Douglas Guilmette was convicted of the 2010 beating death at a South Bend home.

But our partners at the South Bend Tribune report his attorney says lab tests violated his constitutional rights protecting him from unreasonable search and seizure.

Police tested blood found on Guilmette's shoes after he was arrested for shoplifting.

The Indiana Court of Appeals sided with him... Now the state is asking the Indiana Supreme Court to hear the case.

Guilmette is serving a 92-year sentence in the murder.
