Parents of girl who died in foster care might sue

INDIANAPOLIS (AP) — An Indianapolis couple whose 3-year-old daughter died in foster care have notified the Indiana Department of Child Services that they intend to sue the agency for wrongful death.

Miyanna Chowning died Dec. 31 of pneumonia, with a seizure caused by cerebral palsy as a contributing factor, said Alfarena Ballew, Marion County's chief deputy coroner.

Parents Michael Chowning and Shawanna Lacy state in a tort claim notice that DCS placed their daughter with foster parents not qualified or able to provide adequate care. They also accuse the agency of failing to properly monitor Miyanna's care, allowing the child to develop the breathing and lung problem that caused her death.

"The death of Miyanna Chowning was caused by the negligence of DCS," the claim states.

DCS spokeswoman Susan Tielking said the agency has forwarded the claim to the attorney general's office, which represents state agencies in lawsuits.

Tielking said confidentiality regulations barred her from discussing details of the case or disclosing the identity of the foster parents.

The foster parents were not named in the claim.

Attorney Patrick Baker, who represents Chowning and Lacy, said Miyanna should never have been taken from them.

Baker said DCS never alleged any abuse or mistreatment of Miyanna and left another child in the couple's care. He said DCS removed Miyanna because the girl had lost weight, but he noted she had cerebral palsy and mental, developmental and other health problems.

Instead of placing Miyanna where her medical needs could be met, DCS placed her with overwhelmed foster parents who weren't capable of providing the care she required, Baker said.

"It is my understanding that there were seven or eight other kids, at least some of them foster children, in the home," Baker said.

Filing a tort claim is the first step in the process to seek damages from a government agency. If the state does not approve the claim within 90 days, the complaining party has two years to file a lawsuit. The notices do not state a specific amount of damages being sought.

It's the second such notice filed against DCS since May in connection with a Marion County foster child death. Randi Linden also has said she intends to sue DCS, contending her daughter, 7-week-old Destiny, also was improperly removed before her death April 29, eight days after being placed in a foster home.

The cause of Destiny's death remains undetermined pending test results, but Ballew, the deputy coroner, has said it appeared to result from the child sleeping in an unsafe position.

At least four Marion County children have died since November while under DCS supervision.

Me and my wife have been doing foster care for about 9 months. We currently have 3 kids in our care and would love to have more but our house is too small and don't have adequate transportation for more than 3. I hear way too often from friends and co-workers who say we are doing a great thing with these kids. The kids are doing great, I can attribute this too having their needs met on a regular basis. If a kid remains in cps or dhs care than the parents are not doing what they should.

It's been nearly 16 years since I had my run-in with CPS. My son was diagnosed as diabetic and was hopiitalized many times with ketoacidosis. He was released, at one point, when I thought he needed more care, yet one woman said he should go home. Lo and behold, he was re-entered into the hospital with high blood sugars. At this point, the woman who released him called CPS on me and said I was unfit and they took my son away. Needless to say, there was no case, I won. THEY DO MAKE MISTAKES!!

Them do a good job get real. They like to tear families apart. I don't find it funny when families are split apart. I don't think that they need any creadit. I couldn't take some ones child away like they do. Sometime it might be for a good reason but most of them aren't. How well we know.

You know my daughter is skin and bones. She comes from a family that looks that way. Tall and skinny. It is natural for her to look that way. She does eat, so there’s proof kids can be skinny and healthy, and she is healthy. She practically bounces of the walls with energy.

they do remove kids just for loosing weight, I know I am a foster parent and the foster agencey almost place a child with me for that reason but they parents were smarter than cps and got a court order to have the child hospitalized for evaluation first. The child also has CP, most, not all kids with CP are smaller than healthy kids, when you look at height and growth weights on the computer for heathly kids next to it is one for kids with PG. Parents won! CPS is ignorant about special needs.

they make a pretty penny being a foster care parent there ae some good ones and bad ones But honestly they lye to the kids and if they adopt your child they get about 800 dollars a month/and if your child need special care they get more money then they get a 200 doller clothing vocher

I feel I must stand up for CPS. People need to remember how difficult it is to do what CPS workers do. They are underpaid and overworked. The average career for a case worker is only 4 years because there job is so overwhelming! They have the best of intentions, yet there is so much pain and suffering that they burn out. People love to complain about them, but keep in mind; could you do there job? Somebody give them the credit they deserve!

U know everyone thinks that DCS are good people but they are a pain in the butt. They think that this is all funny and it's not. Our kids were taken because of someone else and I don't find that real fair. So what DCS is saying that it's ok to do drugs with your kids in the house and it's ok. I think that this matter with this little girl needs to be taken care of because that mother will never have her little girl back and that is wrong. Our thoughts and prayers go out to the family of the girl

to i hate cps i know what you are saying we were foster cair givers but i was then one being abused by to of the girls and one pushed me down and i craked my ribs and cop said she did not nean to do it but we tryrd to get her help but no one would listen we were the ones that we bad and the kids were taking from us we had people see what was going on but cps would not look into it the kids were our grandkids cps treated us like dirt no more helping kids we are done

DCS don't really care about the kids because they like to move them from one foster home to another. They take children from their parents that don't really do anything wrong but people can smoke pot and do other drugs in their home with the children there. OK what is wrong with this system? Kids that need to be taken aren't and the ones that need to be with their parents are taken. Don't understand how they work. Maybe DCS needs help as well or taken from their families, them they might hurt.

CPS came to my house. Someone who didn’t like me called them, and accused me of letting my children outside on their own, living in a dirty home, and no food. They only thing dirty was the master bedroom. We don’t have storage. Kids don’t go in there. We had food and are always outside with our kids. She falsified her report and said I called the kids stupid. I called myself stupid not my children. I almost hate her for saying I called my children stupid. She must know who called.

DFCS/CPS will remove an ill child for weight loss citing "failure to thrive". Most of the time the parents were counseled by a doctor and did not follow through. So the doc probably made the report and CPS will not aruge. The sad thing is that this child died regardless of who one wants to point the finger at. :(

Sounds as if an internal investagation needs to be in the DCS. It sounds as if there is negligence with in the service and the state needs to be held accountable.
