Jury awards $300,000 to family over casket mishap

INDIANAPOLIS (AP) — A jury has found a Greenwood cemetery negligent and awarded $300,000 to four members of a family after a relative's casket broke apart as workers removed it from a vault.

When William Joseph Henry died in March 2002, a mausoleum chosen by his family still was being built. Seventeen months later, in August 2003, family members gathered to watch workers move the cherry wood casket from its temporary vault at Forest Lawn Memory Gardens.

The body had decomposed, and the casket's handles broke off the casket, sending it to the ground.

Linda Anderson-Hardwick, 57, said the money would mean little if another family ever had to endure the same shock.

"It's been horrific," she said. "Now, maybe my brother can rest."

Jim Young, an Indianapolis attorney who represented Henry's son, Christopher, said cemetery employees violated the cemetery's policies by not using a tray to guide the casket out of the vault or covering it with a sheet.

After the verdicts were read Wednesday in Marion County Superior Court, the family received an apology from Ronald Robertson, a vice president of Memory Gardens Management Corp., Forest Lawn's owner.

The current owners bought the cemetery after the casket incident.

Memory Gardens was placed in receivership this year after Marion County prosecutors accused the current owners of raiding the trusts of Forest Lawn and other cemeteries. That case still is pending in court.

excuse me but if coffins are suppossed to decompose why are they put in concrete vaults? and why are all those coffins that are dug up after decades by the medical examiner still intact? they have dug up bodies after 30 to 50 years and found coffins and the bodies in them intact.

CasketBuilder? are you kidding? it's normal for a casket to fall apart in seventeen months, you even said so yourself, it takes two years, and then another year, for the body? which one is right?? seventeen months is a bit too early for it to be falling apart, don'tcha think? i'm glad this family won $300,000. shoulda been more, because the casket manufacturer or "CasketBuilder" as he likes to be called....GOOFED UP!!!

Coffins are made to decompose within 3 yrs, the body will then start within a year after that. This perfectly normal and it's the industry standard. The fact that the family won is not right. Coffins are not ment to be dug back up. I build Cherry Wood coffins every day and this was one of mine, The family is not suing the company because our contract explained all of this to them and they signed off. If people would read the small print, there would be alot less chances to sue. viva la caskets!

Correct me if I am wrong, but isn't a casket supposed to decompose along with the body inside. These people should have sued the casket manufacturer, not the cemetery. What a ridiculous article. I cannot believe a judge and jury listened to this nonsense!

Caskets and funerals are very costly. Can you imagine paying out thousands of dollars for this deal, then only 16 months later the casket is falling apart? The body is decomposed and could have possibly fell out as well. Can you imangine that being your spouse, parent, child,or whomever in that shabby casket? Uncle Sam will get almost half of that money and then the family will get the rest after new casket, lawyers fees, court fees, etc. Still think it's too much?

WAit a minute here! the story mentioned a CHERRY WOOD casket. Those are not cheap and should not have fallen apart like it did. If you spend thousands of dollars on a box to burry your loved one it should not fall apart that easily! Glad they got something for it but i think 300k is a bit much!

People in a business setting shoud stand up and take notice. When people are spending their money, they want quality workmanship. I can believe they sued, I would have too. Let's see it happen to you and your family during your grieving time. You would think twicw. It has nothing todo with this country being suit happy.
