INDIANAPOLIS (AP) — A prosecutor is charging the 2008 Democratic candidate for lieutenant governor with misrepresenting himself as a state legislator to avoid arrest.

A spokesman for the Marion County prosecutor's office says former Rep. Dennie Oxley II is being charged with misdemeanor counts of public intoxication and impersonating a public servant.

Prosecutor Carl Brizzi scheduled a news conference for later Wednesday to discuss the charges.

Police say the 38-year-old Oxley and a 21-year-old woman were found drunk at a downtown Indianapolis gas station early Friday and that he claimed immunity from arrest because the Legislature was in session.

Oxley did not seek re-election last year to his legislative seat from southern Indiana after he was nominated for lieutenant governor.
