INDIANAPOLIS — A defense attorney says the full story about the encounter between Indiana's 2008 Democratic candidate for lieutenant governor and police officers has not yet been told.

Former state Rep. Dennie Oxley II appeared Thursday in a Marion County court, a day after he was charged with misrepresenting himself as a current state legislator last week to avoid arrest for public intoxication. His bond was set at $500 and a judge required him to submit to alcohol testing twice a week.

A judge had issued an arrest warrant for Oxley after he failed to surrender to authorities as expected Wednesday afternoon.

Defense attorney Rick Kammen said Oxley did not surrender then because he wanted to avoid the news media that was awaiting his arrival.
