SOUTH BEND – A new development in a high profile local case.
A jury will be allowed to hear most of the two conversations a St. Joseph County mother had with police after she found her two young children trapped in the trunk of her car.
The judge issued his decision on Wednesday after Jacqueline Wilk and her attorney tried to get the two police interviews thrown out.
Wilk is charged with neglect that resulted in the death of her two children.
Her 2-year-old and 4-year-old sons died after she found them locked in the trunk of her car at their home in New Carlisle in June of 2011.
The 25-year-old's attorney claims police didn't read Wilk her rights and never told her she was under arrest when they talked to her the day the kids were found and again four days later.
Wednesday, the judge ruled the jury will be allowed to hear a 20 minute interview Wilk gave Metro Homicide detectives at the hospital and most of a two hour interview with police that happened four days later.
The judge says the small portions he's omitting are irrelevant, repetitive or contain hearsay.
Wilk's trial is scheduled to start February 4.
