SOUTH BEND — A 16-year-old boy is facing felony rape and child molesting charges for allegedly having nonconsensual sex with a 13-year-old girl, according to court documents filed earlier this month in St. Joseph Superior Court.
The alleged incident occurred in the early morning Nov. 27 at a home in Lakeville, according to court documents.
Kody Oliver is accused of forcing the 13-year-old to have sex with him, according to court documents. The victim told police she was at a home with Oliver and others on the night of Nov. 26, according to court documents. She told police she awoke to him having sex with her, according to court documents. She said she repeatedly told him to stop and that she was in pain, but he allegedly did not, according to court documents.
Oliver faces one count of child molesting and one count of rape, both Class B felonies, according to court documents.
According to St. Joseph County Procescutor's Office, the judge denied Oliver of a bond reduction but did request for reduction on his next hearing on January 5, 2012. His trial date is set for April 30.
He is being prosecuted as an adult because of the type of crime and the fact that Oliver is at least 16 years old, according to the prosecutor’s office.
He is being held in the St. Joseph County Jail on a $5,000 bond, according to jail records.
A Class B felony conviction carries a sentencing range of between six and 20 years.
