Fox59 News learned former Carmel High School basketball senior Brandon Hoge will take a plea deal next Wedesday for his role in the bus hazing attack.

The Davis' with their attorney remain the only victim's parents to speak. A news conference was called Tuesday, where parents of one victim expressed their feelings about the latest potential plea agreement.

"We did not know about the plea agreement," said their attorney, Bob Turner.

"We haven't been part of it, we don't even exist," said Mr. Davis, the victim's father.

Mrs Davis was near tears during a news conference Tuesday.

"There isn't an evening that goes by, that we can relax to know our son is gonna be okay," she said.

She remains adamant her son did not embellish what happened to him.

"Are you kidding me? We would not turn our lives upside down for what?" she told reporters.

Kitzinger remains the only former player still facing an unresolved battery charge for the alleged school bus incident.

"Where does it end?" said Mr. Davis, describing he's gone through the last 10 months.

"Every morning I get up, go wake up my son and before I touch that door handle, I say a prayer first and say 'God, let my son still be there.' {It has} been so painful. Years from now, I don't know where my son will be mentally. He's going through a heck of a lot," said Davis.

Their son was not in attendance at Tuesday's news conference. His parents said he was at the gym, playing basketball like a 15-year-old should.

Now, learning about Hoge's potential plea agreement, the Davis' ask for one thing:

"An apology, let's start there," said Mr. Davis.

"We shouldn't have to give up so much of our lives in defending all victims, not just our child," said Mrs. Davis.

There will be a civil suit in federal court with an opportunity to subpeona witnesses and the victim's attorney will be able to ask them why they've changed stories and a minute gap of tape at a critical point in the video. Grand jury testimony and a criminal case may be over for the four accused players (Brandon Hoge, Scott Laskowski, Oscar Falodun and Robert Kitzinger) but there is still a possibility of a justice department investigation and they do have a criminal division.
