Indiana Secretary of State Charlie White is set to appear before the Indiana Recount Commission Tuesday.

White will have to choose his words carefully because anything he says in the hearing can be used in his criminal case, according to a Marion Circuit Court judge.

The Indiana Recount Commission will hear arguments on whether White was legally registered to vote when he ran for office. White faces seven felonies in Hamilton County including voter fraud.

White goes to trial on those charges in August.
