19. Howard Finkelstein, Chief Public Defender, Broward County

Last week: The story of the week and perhaps the future of America is that our government, in the name of national security, has been snooping into news agencies’ emails and phone calls and now appears to be snooping into other’s private communications at will. What happens in the aftermath of these revelations will define what it means to be free and what it means to be American. Benjamin Franklin said early in our history, “those who would give up essential liberty to purchase a little temporary safety, deserve neither liberty or safety.” We must now first decide whether we have to choose between privacy and security and if so, where we draw the line. Is it necessary to tap the emails and phone lines of news agencies or me or you in order to secure this nation? If so, what should we require of the government before authorizing this invasion of privacy? We must also decide whether Edward Snowden, the person who unilaterally determined what was best for the nation and what laws he would follow, is a hero or a traitor. But for his decisions, we would never have known of the government’s abuses. Will his revelations ultimately protect our privacy? This is not just a passing news story- it goes to the heart of who we are and what we stand for. We must pay attention and participate in the discussion. The very essence of America is at stake.
