MARTINSBURG, W.Va. —Police seized marijuana and suboxone from a Hagerstown man early Wednesday near Martinsburg and charged him with two counts of possession with intent to deliver the drugs, according to Berkeley County Magistrate Court records.
Decarlos Anthoni Smith, 21, of 464 McDowell Ave., was being held in Eastern Regional Jail Wednesday night on a $50,000 bond set by Berkeley County Magistrate Joan V. Bragg, according to court and jail records.
Merson said he was on foot patrol in the area of a loud party at 48 Boarman Place when he spotted the defendant leaving the residence, according to court documents.
Merson said several other males were heard talking about the defendant having drugs after Smith left the residence, according to court documents.
When confronted by the deputy, Smith denied having drugs, Merson said. Merson said a pat down for security reasons led to the discovery of the marijuana and prescribed drug in the defendant’s right front pants pocket, according to court documents.
